Terms and Conditions

Article 1 (Purpose)
The purpose of these General Terms and Conditions is to provide the rights, obligations, and duties of Q-Hair Test and users with respect to the use of the Internet related services provided by the YS Institute of Environmental Technology (the “Electronic Commercial Transaction Institute”) at the Internet site of Q-Hair Test (hereinafter referred to as the “Services”).
Article 2 (Definition)
  • ① Q-Hair Test shall refer to a virtual business place established to transact goods, etc. by using information communication facilities including computers in order for the YS Institute of Environmental Technology to provide users with goods or services (hereinafter referred to as the “Goods, etc.”), and also refer to the Institute operating a cyber mall.
  • ② A “User” shall refer to members and non-members who receive the services provided by the Q-Hair Test pursuant to these General Terms and Conditions by getting access to the Q-Hair Test.
  • ③ A “Member” shall refer to one who has subscribed to membership by providing its personal information to the Q-Hair Test, and can continue to be provided with information of the Q-Hair Test and continue to use the services provided by the Q-Hair Test.
  • ④ A “Non-Member” shall refer to one who use the services provided by the Q-Hair Test without subscribing to membership.
Article 4 (Provision and Change of Services)
  • ① Q-Hair Test shall post on the first service screen (the front view) of the cyber mall of the “Q-Hair Test,” the provisions of these General Terms and Conditions, the trade name and the name of the representative director, the address of the business place location (including the address where consumers’ complaints may be handled), the telephone number, the facsimile number, the e-mail address, the business registration number, the telecommunication sales business declaration number, the personal information control manager, etc. in order for users to easily know of the information; provided, however, that the provisions of these General Terms and Conditions may be made for users to see through the connection screen.
  • ② Q-Hair Test shall obtain verifications of users by providing an independent connection screen or popup screen, in order to ensure that users can understand significant matters, such as withdrawal of offer, liability for shipping, conditions for refund, out of the matters specified in these General Terms and Conditions before they consent thereto.
  • ③ Q-Hair Test may amend these General Terms and Conditions to the extent that it does not violate relevant laws, including the Consumer Protection Act on Electronic Commercial Transactions, the Act on the Regulation of General Terms and Conditions, the Framework Act on Electronic Transactions, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the Act on Door-to-Door Sales, etc., the Consumer Protection Act.
  • ④ In the event that Q-Hair Test shall amend these General Terms and Conditions, it shall specify and publicly announce the date of application and the ground of amendment on the first screen of the mall together with the current general terms and conditions from seven (7) days before the date of application until the date immediately preceding the date of application; provided, however, that in the event that it changes the provisions of these General Terms and Conditions unfavorable to users, it shall publicly announce the changes with a previous grace period of at least not less than thirty (30) days. In this case, Q-Hair Test shall clearly compare and specify the provisions before and after the amendment such that users can easily see relevant provisions.
  • ⑤ In the event that Q-Hair Test has amended these General Terms and Conditions, the General Terms and Conditions as amended shall be applicable only to an agreement to be entered into after the date of application, and as for an agreement previously entered into, the provisions of the General Terms and Conditions before the amendment shall be applicable as they are; provided, however, that the provisions of the General Terms and Conditions as amended shall be applicable if a user who had previously entered into an agreement sent to Q-Hair Test its intention to make the General Terms and Condition as amended applicable and obtain consent thereto from Q-Hair Test within the notification period of the General Terms and Conditions as amended pursuant to Section 3.
  • ⑥ With respect to any matter not specified in these General Terms and Conditions and any interpretation of these General Terms and Conditions, the Consumer Protection Act on Electronic Commercial Transactions, etc., the Act on the Regulation of General Terms and Conditions, the Guidelines for Consumer Protection on Electronic Commercial Transactions, etc. specified by the Korea Fair Trade Commission, relevant laws, or commercial practices shall be applicable.
Article 5 (Suspension of Services)
  • ① In the event that there is a ground that information communications facilities including computers are to be repaired and checked, exchanged, or malfunctioned, or relevant communications have been disconnected, Q-Hair Test may temporarily suspend its provision of the services.
  • ② Q-Hair Test shall compensate for damages incurred to users or third parties as a result of the temporary suspension of provision of the services on the ground of Section 1; provided, however, that an exception shall be made where Q-Hair Test has proven that there is no willfulness or negligence.
  • ③ In the event that Q-Hair Test has become unable to provide the services on the ground that it had converted its business items, renounced its businesses, or combined with another company, etc., it shall notify users thereof in the method specified in Article 8 and indemnify consumers according to the conditions originally specified by Q-Hair Test; provided, however, that in the event that Q-Hair Test has not made a public announcement for the indemnification criteria, etc., it shall give users relevant things or cash equal to the currency value circulated by Q-Hair Test, including mileages or accumulated monies of users.
Article 6 (Subscription to Membership)
  • ① A user shall apply for subscription to membership by entering its member information according to a form of subscription specified by Q-Hair Test and expressing its intention to consent to these General Terms and Conditions.
  • ② Q-Hair Test shall register as its members the users who have applied for subscription to membership as specified in Section 1 unless each of the following cases applies:
    1. In the event that an applicant for membership has ever lost its membership status pursuant to Article 7 Section 3 of these General Terms and Conditions; provided, however, that an exception shall be made where three (3) years passed after the applicant had lost its membership status pursuant to Article 7 Section 3 but obtained approval for re-subscription to membership from Q-Hair Test;
    2. In the event that an applicant for membership has entered false information, omitted information, or entered mistaken information; or
    3. In the event that registration of an applicant for membership as a member is otherwise found to cause a serious difficulty to the technologies of “Q-Hair Test.”
  • ③ An agreement for subscription to membership shall be formed at the time when approval by Q-Hair Test has arrived to a member.
  • ④ In the event that a member changes its registration information pursuant to Article 15 Section 1, it shall immediately inform Q-Hair Test of the change(s) by e-mail or another relevant method.
Article 7 (Withdrawal from Membership, Disqualifications, etc.)
  • ① A member may at any time request Q-Hair Test to withdraw its membership, in which case Q-Hair Test shall immediately withdraw the member from membership status.
  • ② In the event that a member falls under each of the following cases, Q-Hair Test may restrict or discontinue its membership status:
    1. In the event that a member has registered false information at the time of applying for subscription to membership;
    2. In the event that a member failed to make a payment for the goods, etc. it had purchased by using Q-Hair Test or otherwise to make a payment for liabilities to be borne by it with respect to the use of Q-Hair Test on a due date of payment;
    3. In the event that a member has threatened an order of electronic commercial transactions by obstructing a third party’s use of Q-Hair Test or misappropriating the information; or
    4. In the event that a member has engaged in an activity prohibited under the laws or these General Terms and Conditions or against public order and good morals by using “Q-Hair Test.”
  • ③ In the event that after Q-Hair Test had restricted or discontinued a member’s membership status, the member repeated the same activity not less than two time or failed to correct the ground of restriction or discontinuance within thirty (30) days, Q-Hair Test may disqualify the member.
  • ④ In the event that Q-Hair Test has disqualified a member’s membership status, it shall erase its membership registration. In this case, Q-Hair Test shall notify the member thereof and give the member an opportunity to make a relevant explanation by specifying a period of at least not less than thirty (30) days before the membership registration being erased.
Article 8 (Notification to Members)
  • ① In the event that Q-Hair Test gives a notice to a member, it may do so with the e-mail address previously agreed upon and designated by the member with “Q-Hair Test.”
  • ② In the event that Q-Hair Test gives a notice to many and unspecified members, it may replace individual notifications with posting the notice on a bulletin board of Q-Hair Test for not less than one (1) week; provided, however, that with respect to matters that may have a significant effect on members’ own transactions, Q-Hair Test shall give individual notifications to relevant members.
Article 9 (Application for Purchase)
Users of Q-Hair Test shall apply for purchase on the Q-Hair Test in the following or similar ways, and when a user has applied for purchase, Q-Hair Test shall provide each of the following matters for the user to easily understand them; provided, however, that Section 2 or 4 may not be applied for members.
  1. Searching and selecting the goods, etc.;
  2. Entering names, addresses, telephone numbers, e-mail addresses (or mobile phone numbers);
  3. Verifying matters on the provisions of the General Terms and Conditions, the services with a restricted right to withdraw offers, payment of costs for shipping, installation expenses, etc.;
  4. Consenting to the General Terms and Conditions, verifying or expressing its objection to the matters in the above-mentioned subparagraph 3 (e.g., clicking with a mouse);
  5. Applying for purchase of the goods, etc. verifying the application, or consenting to a verification by Q-Hair Test; or
  6. Selecting a payment method.
Article 10 (Formation of Agreement)
  • ① In each of the following cases, Q-Hair Test may not approve an application for purchase in Article 9; provided, however, that if it enters into an agreement with a minor, it shall inform the minor that an agreement with the minor or its legal representative may cancel the agreement unless it obtain consent from its legal representative:
    1. In the event that a member has entered false information, omitted information, or entered mistaken information;
    2. In the event that a minor has purchased goods or services prohibited by the Juvenile Protection Act, such as tobaccos, alcohols; or
    3. In the event approval of an application for purchase is otherwise found to cause a serious difficulty to the technologies of “Q-Hair Test.”
  • ② An agreement shall be deemed formed at the time when approval by Q-Hair Test has arrived to a user in the form of notification of confirmation of receipt in Article 12 Section 1.
  • ③ Q-Hair Test’s expression of its intention to approve shall include whether it can verify and make sales for a user’s application for purchase, and information on corrections, cancellations, etc. with respect to a user’s application for purchase.
Article11 (Payment Method)
As for payment methods for the goods or services purchased by using “Q-Hair Test,” available methods out of each of the following methods may be used; provided, however, that in connection with a user’s payment method, Q-Hair Test may not charge any additional fee in whatever names with respect to monies for the goods, etc.:
  1. Various account transfers including phone banking, the Internet banking, mail banking;
  2. Various card payments including prepaid card, debit card, credit card;
  3. Online deposit without a bank book;
  4. Payment by electronic currency;
  5. Payment at the time of receipt;
  6. Payment by points given by “Q-Hair Test,” including mileages;
  7. Payment by gift certificates for which an agreement was entered into with Q-Hair Test or accepted by Q-Hair Test; or
  8. Payment by other electronic payment methods.
Article 12 (Notification of Confirmation of Receipt, Change or Cancellation of Application for Purchase)
  • ① In the event that a user has applied for purchase, Q-Hair Test shall notify the user of conformation of receipt.
  • ② In the event that a user who has obtained a notice of conformation of receipt finds that there is a disagreement, etc. on the expression of its intention, it may request Q-Hair Test to change or cancel the application for purchase immediately after having obtained a notice of confirmation of receipt, and if a user has made a request before shipping, Q-Hair Test shall handle it without delay according to the request; provided, however, that if a user has previously made a payment, the provision of withdrawal of offers in Article 15 shall be applicable.
Article 13 (Supply of Goods, etc.)
  • ① Unless there is an independent agreement with a user as for the time for supply of the goods, etc., Q-Hair Test shall take necessary measures for manufacturing by order, packing, etc. in order to ship the goods, etc. within seven (7) days from the date when a user has made an offer for purchase; provided, however, that if Q-Hair Test has received a payment for the goods, etc. in whole or in part, it shall take measures within two (2) business days from the date of its receipt of relevant amounts in whole or in part. In this case, Q-Hair Test shall take appropriate measures to ensure that users can verify the supply procedures and progresses of the goods, etc.
  • ② Q-Hair Test shall specify the shipping methods, payer for shipping expenses by shipping method, the shipping time by shipping method, etc. with respect to the goods purchased by users. If Q-Hair Test has exceeded an agreed-upon shipping time, it shall compensate for damages incurred to users; provided, however, that an exception shall be made where Q-Hair Test has proven that there is no willfulness or negligence.
Article 14 (Refund)
In the event that Q-Hair Test is unable to deliver or provide the goods, etc. applied for purchase by a user because the goods, etc. have been sold out, etc., it shall notify the user of the ground without delay, and if Q-Hair Test has received relevant monies for the goods, etc., it shall refund the monies or take relevant measures for refund within two (2) business days from the date of its receipt of the monies.
Article 15 (Withdrawal of Offers, etc.)
  • ① A user who has entered into an agreement for purchase of the goods, etc. with Q-Hair Test may withdraw its offer within seven (7) days from the date of its obtaining a notification of confirmation of receipt.
  • ② In the event that a user has received the goods, etc. by shipping, in each of the following cases, it may not receive a refund or an exchange of the goods, etc.:
    1. In the event that the goods, etc. have been lost or damaged at a user’s fault (however, a user may withdraw its offer if it has damaged packing, etc. to verify the content of the goods, etc.);
    2. In the event that the value of the goods, etc. has been conspicuously reduced by use or some consumption by a user;
    3. In the event that the value of the goods, etc. has been conspicuously reduced to the extent that it is difficult to resell the goods, etc. due to the lapse of time; or
    4. In the event that if it is possible to duplicate the goods, etc. with the same functionality, a user has damaged packing of the originals of the goods, etc.
  • ③ In the case of Section 2 Subparagraph 2 or 4, if Q-Hair Test has not taken relevant measures to specify advance relevant restrictions on withdrawal of offers, etc. on a place where consumers can easily see, or to provide free trial products, users’ withdrawal of offers, etc. shall not be restricted.
  • ④ Notwithstanding the provision of Section 1 or 2, in the event that the content of the goods, etc. is different from the labeling or advertising content or has been performed different from the agreements, a user may withdraw its offers, etc. within three (3) months from the date when the user has been supplied with the goods, etc. and within thirty (30) days from the date when the user knew or could have know of the difference(s).
Article 16 (Consequences of Withdrawal of Offers, etc.)
  • ① In the event that Q-Hair Test has received a return of the goods, etc. from a user, it shall give the user a refund for relevant amounts paid for the goods, etc. within three (3) business days. In this case, in the event that Q-Hair Test has delayed in giving a relevant user a refund for the goods, etc., it shall pay an interest for delay calculated in multiplying the delay period by an interest rate for delay prescribed and publicly announced by the Fair Trade Commission.
  • ② As for refund of relevant payments, when a user has made a payment for the goods, etc. with a payment means of a credit card or an electronic currency, etc., Q-Hair Test shall without delay request the business entity having provided the payment means to discontinue or cancel the payments for the goods, etc.
  • ③ As for withdrawal of offers, etc., a relevant user shall pay costs necessary to return the supplied goods, etc. Q-Hair Test shall not request a user to pay a penalty or compensation for damages on the ground of its withdrawal of offers, etc.; provided, however, that if a user has withdrawn its offers, etc. because the content of the goods, etc. is different from the labeling or advertising content or had been performed different from the agreements, Q-Hair Test shall pay costs necessary to return the goods, etc.
  • ④ In the event that a user has paid relevant shipping costs in receiving the goods, etc., Q-Hair Test shall clearly indicate who is to pay the costs in order for users to easily see.
Article 17 (Personal Information Protection)
  • ① Q-Hair Test shall collect information of users to a minimum extent necessary to perform a purchase agreement. The following matters shall be required ones, and other matters shall be selective ones:
    1. Name
    2. Address
    3. Telephone Number
    4. Desired ID (for a member)
    5. Password (for a nonmember)
    6. E-mail Address (or Mobile Phone Number)
  • ② When Q-Hair Test is to collect personally identifiable information of a user, it must obtain consent from the user.
  • ③ The provided personal information may not be used for purposes other than the purpose of the provision or given to a third party without consent by a relevant user, and the mall shall be held responsible therefor; provided, however, that an exception shall be made in each of the following cases:
    1. In the event that for purposes of shipping, Q-Hair Test informs a shipping company of a user’s information (name, address, telephone number) to a minimum extent necessary to ship the goods, etc.;
    2. In the event that relevant information is required to prepare statistics, conduct academic research, or investigate markets, and is provided in a form that specific individuals cannot be identified;
    3. In the event that relevant information is required to make a payment for transactions of the goods, etc.;
    4. In the event that relevant information is required to verify identities to prevent misappropriation thereof; or
    5. In the event that relevant information is unavoidably required by the provisions of laws or regulations.
  • ④ In the event that Q-Hair Test is required to obtain consent from users pursuant to Section 2 or 3, it shall in advance specify or publicly announce the requirements prescribed in Article 22 Section 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., including the identification information of a relevant personal information control manager (affiliation, name, telephone number, and any other contact information), the purpose of collecting and using information, relevant matters for providing information to third parties (persons provided with information, the purpose of provision of information, and the content of information to be provided). A relevant user may at any time withdraw such consent.
  • ⑤ Users may at any time request Q-Hair Test to allow it to read or correct mistakes with respect to their information owned by Q-Hair Test. Q-Hair Test shall have the obligation to take necessary measures for such a result without delay. In the event that a user has requested Q-Hair Test to correct mistakes, it shall not use relevant personal information until it corrects the mistakes.
  • ⑥ Q-Hair Test shall restrict and minimize the number of managers to protect personal information, and it shall take all responsibilities for damages incurred to users as a result of loss, robbery, revelation, alteration, etc. of personal information of users, including credit card, bank account.
  • ⑦ In the event that Q-Hair Test or a third party having obtained personal information from Q-Hair Test has accomplished the purpose of collecting and obtaining personal information, it shall without delay destroy the personal information.
Article 18 (Q-Hair Test’s Duties)
  • ① Q-Hair Test shall not engage in an activity prohibited under the laws or these General Terms and Conditions or against public order and good morals, and it shall use its best to provide goods and services continuously and stably as set forth in these General Terms and Conditions.
  • ② Q-Hair Test shall have a security system to protect personal information of users (including their credit information) in order to ensure that users can safely use the Internet services.
  • ③ In the event that Q-Hair Test has caused damages to users by engaging in unreasonable labeling or advertising activities prescribed in Article 3 of the Act on Fair Labeling and Advertising with respect to relevant goods or services, it shall be held responsible for compensating for damages.
  • ④ Q-Hair Test shall not send advertising e-mails for profitable purposes not desired by users.
Article 19 (Members’ Obligations for IDs and Passwords)
  • ① Members shall have the obligation to control their IDs and passwords except for the case of Article 17.
  • ② Members shall not cause a third party to use their IDs or passwords.
  • ③ In the event that a member has become aware that its ID or password has been robbed or used by a third party, it shall immediately notify Q-Hair Test thereof, and if there is a direction given by Q-Hair Test, the member shall follow it.
Article 20 (Users’ Obligations)
  1. Not to register false information in applying for or change the information;
  2. Not to misappropriate a third party’s information;
  3. Not to change information posted on Q-Hair Test;
  4. Not to send, receive, or post information (computer programs, etc.) other than the information specified by Q-Hair Test;
  5. Not to infringe upon intellectual property rights of Q-Hair Test or other third parties, including their copyrights;
  6. Not to undermine reputations of Q-Hair Test or other third parties or obstruct works of Q-Hair Test or other third parties; or
  7. Not to disclose or post on the mall obscene or violent messages, videos, voices, or any other information against public order and good morals.
Article 21 (Reversion of Copyrights and Restrictions on Use)
  • ① The copyrights and other intellectual property rights to the works made by Q-Hair Test shall be reverted to Q-Hair Test.
  • ② Without prior approval by Q-Hair Test, users shall not duplicate, send or receive, publish, broadcast, or in any other way use for profitable purposes, or cause a third party to use any information to which relevant intellectual property rights have been reverted to Q-Hair Test, out of the information obtained by users in using Q-Hair Test.
  • ③ In the event that Q-Hair Test is to use the copyrights reverted to a user according to an agreement, it shall notify the user thereof.
Article 22 (Dispute Resolution)
  • ① Q-Hair Test shall establish and operate a damage compensation handling organization to reflect on reasonable opinions or complaints given by users and compensate for damages.
  • ② Q-Hair Test shall preferentially complaints or opinions given by users; provided, however, that if it is difficult to promptly handle them, it shall immediately notify relevant users of the ground and schedule for handling.

Article 23 (Jurisdiction and Governing Laws)
  • ① A lawsuit on electronic commercial transactions related disputes between Q-Hair Test and users shall be heard in a place where a user is located at the time of the lawsuit, but if there is no such an address, a lawsuit shall be subject to the exclusive jurisdiction of a district court for a place of a user’s residence; provided, however, that if a user’s address or residence in unclear at the time of a lawsuit or a user resides in a foreign country, a lawsuit shall be brought to a competent court of jurisdiction under the Civil Procedure Act.
  • ② An electronic commercial transaction related lawsuit brought between Q-Hair Test and a user shall be governed by the Korean laws.
